Digaaz promises but does not deliver: Photo attached shows Patek Philippe spelling itself is wrong. I have other proof as well. After repeated calls, they did not respond and I was forced to send them a legal notice. HORRIBLE EXPERIENCE. I have even sent them a recording where their sales person Mr. Nikhil committed a full refund into my credit card account. Still no resolution.

SUB: NOTICE BEFORE FILING CONSUMER COMPLAINT

Dear Sir,

On 31-January-2014, I have purchased a product(Your product code: LUWT %u2013 10210), and paid Rs 46268(forty six thousand two hundred and sixty eight) via Citibank Credit Card(transaction & approval number: 545706, claimed by you on 1-Feb).

As per the conversation with your employee Mr. Nikhil, I was assured that I could return the product in 30 days for a complete refund into my credit card account. I want a full refund as I am not satisfied with the product.

· Certificate of Origin is not included: Patek Philippe creates a GENUINE CERTIFICATE OF ORIGIN with each watch. This certificate was missing in the product sent to me.

· Patek Philippe booklet is not original: Spelt as Patek Phiuppe.

· Watch dial is not working: The inner dial of the watch was not working

· No Model number, dates of sale, etc. on guarantee card: A blank card was sent.

· No bill of sale, sales memo provided with the product

I have tried calling representatives of your company and have been promised call backs which have not taken place. Mr. Kabir Shikhawat was to call me on 4th February 2014 at 5:30 PM but there has been no communication from your end. I have emailed your email IDs(support@digaaz.com, quality@digaaz.com, reverse@digaaz.com) on 3rd, 4th, 6th February 2014 but I have not received any response. I have called your representatives each day from 1st to 5th February 2014 but I have not been updated on the matter. I have also informed you via WhatsApp(Digaaz WhatsApp: 9041438777) but I have not been called back. I have sent you the voice recording of the conversation between your employee Mr. Nikhil and myself, where he assures me that the amount will be refunded into my credit card account in case I return the product. I returned the product on 4th February 2014.

You are hereby finally called upon to return the price paid Rs. 46268(forty six thousand two hundred and sixty eight) to my credit card account within seven days otherwise I will file a complaint with the Consumer Court as I am protected under the Consumer Protection Act of 1986.

Despite all my pleadings you have not made good the promise to refund the amount which is indeed regrettable and highly unbusiness like. On account of your aforesaid dereliction of duty and failure and neglect to rectify the same I have incurred expenses in terms of my time and money calling you several times a day. Also, since this is a credit card payment and all interest charges will be borne by you after the seven day period ending on 14th February 2014.

Additionally I would like to inform you that the consumer complaint will be at your cost and expenses, and I will seek compensation for the mental agony caused due to your actions.

I have sent this notice via email to your email IDs: support@digaaz.com, quality@digaaz.com, reverse@digaaz.com
